About Seek | Say
Seek | Say ("App", "Service", "we") is owned and operated by NextJen Labs LLC, a Delaware limited-liability company. The App lets people seek advice, say broadcasts, and exchange location-based content.
Your Acceptance
By creating an account, providing your phone number, and tapping "Send Verification Code", you agree:
- To these Terms.
- To receive SMS messages for login and account verification.
If you do not agree, do not use the Service.
SMS Consent
- Phone numbers are used only to send OTP login codes and necessary account-verification messages.
- Message frequency may vary.
- Standard message and data rates may apply.
- You may reply STOP at any time to opt out, or HELP for assistance.
- Opting out of SMS may affect your ability to access the Service.
Eligibility
You must be at least 13 years old (or the local age of digital consent). If under 18, a parent/guardian must accept these Terms on your behalf.
Accounts & Security
- Provide accurate information and keep it current.
- You are responsible for activity on your account.
- Keep your phone number up to date so you can continue receiving verification codes.
- We may suspend or terminate accounts that violate these Terms.
User Content
- Ownership. You retain your rights in the UGC you post.
- Licence. By posting UGC you grant us a licence to use it to operate the Service.
- Responsibility. You are responsible for your UGC.
- Moderation. We may remove or moderate UGC.
Prohibited Conduct
You agree not to:
- Violate laws or rights of others.
- Post objectionable or harmful content.
- Use another person's phone number without authorization.
- Upload malware or disrupt the Service.
- Scrape, reverse-engineer, or misuse the App.
Credits, Purchases & Refund Policy
Some features of the Service may require in-app credits, which you can obtain by purchasing through your app store account or by other means we make available.
- All purchases are final. Money spent to obtain credits is non-refundable and non-transferable, except where required by law.
- Credits have no cash value. They are a limited license to access features in the Service. They cannot be redeemed for cash or transferred outside your account.
- No refunds on credits used. Once credits are spent (e.g., on a broadcast or other feature), they cannot be reversed, refunded, or restored — even if the resulting content is moderated, expires, or otherwise removed.
- We reserve the right to adjust or revoke credits in cases of misuse, fraud, or error.
Location Services
The App relies on device or user-supplied location data, which may not always be accurate.
AI-Generated Responses
AI-generated content is provided "AS IS" without warranties.
Intellectual Property
App software, branding, and non-UGC content belong to the Company or licensors.
Service Changes
We may modify or discontinue features at any time.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
Limitation of Liability
To the fullest extent permitted, our total liability for any claim shall not exceed USD 100.
Indemnity
You agree to indemnify and hold harmless the Company against claims related to your use of the Service.
Termination
We may suspend or terminate your account if you violate these Terms.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.
Any dispute that cannot be resolved informally shall be resolved by binding arbitration in Delaware, administered by the American Arbitration Association.
You waive any right to participate in a class action.
Changes to Terms
We may update these Terms. Material changes will be notified in-app or by other reasonable means.
Miscellaneous
If any provision is unenforceable, the remainder will remain in effect. These Terms constitute the entire agreement.
